Please be advised that before marketing any property we will need a copy of the following property documentation to comply with decree 218/2005, a law regulating all estate agents operating in Andalucia. If you are unsure of how to obtain any of this information then we will guide you through the process.
- Your purchase escritura
- First Occupation licence (where applicable)
- Current Nota simple (we can obtain this for a fee of 12 euros)
- Last IBI receipt
- Recent Utility bill – for water, electricity, telephone, internet, any other services connected
- Basura Tax (Rubbish tax).
- Community Fees and details (where applicable)
We will provide you with a signed sales agreement prior to listing your property for your records.
TAXES YOU NEED TO PAY WHEN YOUR PROPERTY IN SPAIN IS SOLD
Capital Gains Tax
When you sell a property in Spain, you are liable to pay capital gains tax, payable on the increase in value of the property, less allowances for length of ownership and deductions for verified expenditure on improvements you have made to the property. If you sell as a non resident then 3% retention tax is taken on completion at the Notary as a payment on account against this.
Plus Valía (or Arbitrio sobre el Incremento del valor de los Terrenos)
This is a much smaller tax charged on the sale of your property by the relevant Town Hall. It is based on the increase in the official value of the land since its last sale. This can be charged against the property itself if the seller does not pay it so ensuring this is paid (or allowed for) is often covered as part of the property conveyancing with the relevant sum with-held by the buyer´s solicitor on completion.
